Chandigarh trucks using illegal mining devices cannot be easily released, Punjab and Haryana Superior Court said, while rejecting the bail programs of 18 defendants in a case reported at SBS Nagar.
The Arun Kumar Tyagi High Court noted that the confiscation of cars will be solely convicted by the accused, where the use of cars for illegal mining can be demonstrated by documentary evidence.
The bail programs of the court hearing of 18 other people filed in June oppose an FIR registered in May 2020.Se says petitioners own/handle 29 dumpsters (including 8 sand-filled trash containers), two Poclain machines, two gallop and a motorcycle discovered at the site not authorized by illegal mining. Also before the court that since April 201 FIR has been registered and 299 cars have been seized. Given the seriousness of the situation, the court had appointed the director of the Punjab Department of Mines and Geology as part of the case.
“Because of unwanted human interference with the forces of nature, calamities, which a few years ago were considered an unscientish fiction or remote possibilities, have become harsh realities and nightmares in many parts of the world, endangering human life and even what poses a risk to humanity’s own lifestyles if corrective actions are not taken”” , Judge Array observed, adding that corrective actions across the state deserve to be taken in two weeks and that the court would be informed.
MEASURES LISTED BY STATE IN COURT
To track vehicle movements, the mining industry is creating a portal for online booking, vehicle registration and tracking. Punjab has asked the Center to put the mining tracking system into effect. The District Legal Committee and the District-level Environmental Management Unit must be replaced through the District Mineral Foundation. CDs were invited to conduct review meetings on the prestige of recorded judicial cases and FIR. CDs shall take measures contrary to officials for lack of deposit/delay in the filing of the FIR.
