But enthusiasts of the famous Hermès say exclusivity is the key point.

By Jacob Bernstein

If you need to buy a Birkin bag, the centerpiece of the French luxury space Hermès, you probably can’t do it.

Vogue delivered this message of tough love to its readers in a recent article that called the search for a Hermès bag “intimidating. “The magazine warns that consumers “could wait months or even years until the right style is available” and further hopes are dashed. pointing out that “there are no longer waiting lists at Hermès points of sale”.

The item’s exclusivity is a major component of its appeal, but two California citizens trying to acquire the bags were enough.

On Tuesday, the two buyers in question, Tina Cavalleri and Mark Glinoga, filed a proposed class-action lawsuit against Hermès in San Francisco. In the lawsuit, they accuse the company of withholding the coveted purse for everyone, even top spenders, which the plaintiffs say violates antitrust law.

Hermès responded to requests for comment.

Cavalleri, known in the lawsuit as a California resident, already owns at least one Birkin bag, according to the court complaint, but her attempt to buy one was thwarted.

The lawsuit says Ms. Cavalleri “spent tens of thousands of dollars at Hermès and was forced to purchase” other Hermès items, described as “ancillary products,” before she was able to purchase a Birkin bag.
