Oct. 25 – WATERTOWN – Justice Mark R. Rose needs the state Supreme Court to return to Herkimer County full-time, so he’s running for a seat on the Fifth Judicial District court in hopes of doing just that.
Rose, who is now a judge of approval at Little Falls City Court, said Herkimer County has been without a full-time approval judge assigned to the local judiciary for about 11 years, according to an interview with the offices of the Watertown Daily Times on Thursday.
“Herkimer is the only county that doesn’t have a sentence in the district,” he said. “The court is a branch of government and we have no representation in that branch of government. It’s very discouraging. “
The Fifth Judicial District covers Jefferson, Lewis, Herkimer, Oswego, Oneida, and Onondaga counties, with courts in each of those counties. Each county, with the exception of Herkimer, has at least one ruling assigned to its court, while Oneida County has 3 approved sentences and Onondaga County has 10.
In the 2012 Supreme Court election, when the seat likely to have been allocated to a Herkimer County ruling was elected, Justice Patrick F. MacRae defeated the Herkimer County candidate and sat in Oneida County Court than Herkimer. Since then, the Herkimer County Supreme Court has only had visitors passing sentences, other Supreme Courts passing sentences from across the Fifth Judicial District that are assigned to the Herkimer County Court on a rotating basis.
Rose said this has had a massive impact on court cases there, making things more difficult for litigants and their attorneys. As an attorney who works largely with municipalities such as towns and villages, Mr. Rose had to appear at Herkimer County Court and said he had reveled firsthand in the tricks of having only visiting judges.
“I’ve had instances where I worked with two interim judges and a visiting judge,” he said. “Three judges, all in one case. It’s not fair to litigants, it’s not fair to court officials, and I do.
If elected, Rose said he would bring the full-time court back to Herkimer County to serve the roughly 60,000 other people living there more equitably.
He said he believed he had the experience to serve well as a Supreme Court justice, earning $210,900 a year.
He was born in Syracuse, but grew up in Herkimer County and became a finance student at LeMoyne College in Syracuse. He met his wife, originally from Watertown, in his last semester there.
Rose’s father also passed judgment in Little Falls City court, saying he encouraged him through his father to study law.
“When I went to law school at the University of Illinois, I was in the MBA and law program, and I sought to use the law degree to get a job in business, but I never finished the MBA. “
After leaving law school, he worked in the global business for a year before being told he was “overqualified” for the task and would not be rehired for another year. He returned to Little Falls and worked with his father.
“When I was in law school, I worked with the public defender’s office,” he said. “I tried a few things and found that I liked it. When I came back here, I wasn’t sure what I was going to do, but the prosecutor asked me to take on some cases of court-appointed lawyers. “
In Herkimer County, there is no public defender’s office. Cases are referred to attorneys who agree to accept them for a payment paid through the county.
“I do this, I worked for my father, and because I enjoyed the work, I grew,” he said.
He ran for election to Little Falls City Court, replacing his father, who retired in 2007. He retained his personal practice, serving as an attorney in the vicinity and towns that hired him, as well as in other government agencies.
“I constitute 3 villages, 3 cities, one district and two housing authorities,” he said.
Rose said the experience has allowed him to look at most of the cases that a New York Supreme Court presides: proceedings against municipalities, contract negotiations, financial claims and aspects of family law.
He is to the education of a sports team.
“It’s much less difficult to train if you play the sport,” he said. “And I played this sport. “
Rose said he hopes the electorate in the Fifth Judicial District will see his party and see the need for a hometown judge again in Herkimer County and vote for him in this year’s election. He is running along the Republican and conservative lines, along with 3 other Republican candidates, against a list of 4 Democrats.
There are 4 open seats in the Fifth Judicial District this year, and applicants are not running for express seats. The 4 most sensible applicants of the 8 applicants will fill the seats and be allocated where they are needed. In the county they live in when elected, however, assignments are made through the district’s administrative ruling in January, after applicants are sworn in. The terms of the State Supreme Court are 14 years.
Early voting begins Oct. 29 of this year, with limited voting stations open until all polling stations are open by Election Day, Nov. 8.
