Patent Filing Summary: Funded IP Edge Patents Rise From the Dead; Toyota Challenges InfoGation Patents in PTAB

In a nod to Mark Twain’s quote, rumors about IP Edge’s death are greatly exaggerated. It appears that NPE’s prolific aggregator sold or transferred at least one portfolio (and potentially as many as 40) to a new entity, Inferential Capital, LLC. , which after being hired began to assert itself (more on this below). According to statistics, the week was below average, both in the Patent Appeals and Trials Board (PTAB) and in the district courts. In the PTAB, there were 25 new patent applications, with one post-grant examination and 24 inter partes examinations (IPRs).

The PTAB issued 25 institutional resolutions this week. Ten of those resolutions rejected the establishment on its merits, while the other 15 granted it. The refusals included 3 IPRs from Medit Corp. challenging 3 patents from 3shape Inc. and Samsung’s 3shape A and 3 IPR challenging two patents from Headwater Research LLC [associated with Greg Raleigh]. However, Medit and Samsung also obtained a favorable ruling from an establishment challenging a patent by 3shape Inc. respectively, and 3shape A and a patent from Headwater Research LLC. Cisco and Juniper Networks Inc. also obtained favorable resolutions of the establishment. in two IPRs challenging a patent of Orckit IP LLC [Orckit-Correct] and Cisco obtained a favorable ruling in an IPR challenging a patent of Video Solutions Pte Ltd. The PTAB issued 3 final written decisions this week, adding that all of the challenged claims were not patentable in two cases through Askeladden LLC [The Clearing House LLC] challenging a patent by Kioba Processing LLC [IP Investments Group LLC]. While G Communications LLC effectively defended its patent against an IPR filed through Samsung, the PTAB found that any challenged claims were not patentable.

Meanwhile, the District Court has recorded 49 new cases. Ten of those cases have been filed through biomedical companies, new crusaders from Intra Cellular Therapies Inc. and Arcutis Biotherapeutics Inc. ‘s family plaintiffs also continued their crusades this week, the acquisition of an old crusade from Endobotics LLC, 3 new filings from Intercurrency Software LLC, and a new filing through Aml IP LLC [related to Dynamic IP Deals, LLC (d/b/a DynaIP)]. Encryptawave Technologies LLC [associated with Inferential Capital LLC] filed its first campaign this week, announcing a similar patent for security authentication for wireless communication networks against TCL Electronics Holdings Ltd. , Sharp Corporation and D-Link Corporation.

The claimed patent has already been claimed through Moxchange LLC [associated with IP Edge LLC] in opposition to more than 30 defendants. The patent was granted, along with several other patents, to Encryptawave through Moxchange in February of this year. Encryptawave said in its corporate statement that its parent company is Inferential Capital LLC, a Delaware company established in July last year. According to a recent job advertisement for a “co-founder and fundraising expert,” Inferential Capital has acquired 40 patent portfolios. As the Encryptawave dossier demonstrates, at least one of those wallets was won by IP Edge. This week, Toyota filed two opposing intellectual property rights to two patents of InfoGation Corp. , marking the first PTAB to demand situations contrary to InfoGation’s patents through the defendant automakers.
