A UK labour court has ruled that non-binary, gender-based people are under the Equality Act.
The Equality Act protects others from discrimination based on age, disability, gender change, marriage and civil union, pregnancy and maternity, race, faith or belief, sex, and sexual orientation.
But a historical resolution will now extend this coverage to other non-binary and fluent gender people in the “sex change” category.
The case was presented by a non-binary engineer working at the Jaguar Land Rover (JLR) factory. Taylor stated that they were harassed and directly discriminated against due to gender change.
Ms. Taylor, who is not binary, also told the court that she struggled with toilet and support management.
Jaguar Land Rover argued that, because of their non-binary identity, they fell within the definition of sex replacement in the Equality Act 2010 if the court had accepted, it would have excluded them from the protections that the Equality Act provides to individuals.
Today, however, A upheld Ms. Taylor’s allegations of harassment, direct discrimination and victimization.
Adding that “it’s clear . . . that sex is a “spectrum” and that it is” beyond doubt “that the identity of the applicant was within the definition.
The historical judgment means that many other gender, cisgender and transgender identities would possibly also fall within the definition of gender replacement in the Equality Act.
Robin Moira White of Old Square Chambers, representing Ms. Taylor, said:
“This is a judgment, albeit at trial, that detects for the first time the rights of a small number of Americans with complex gender identities. Once again, the courts have demonstrated their willingness to protect Americans’ rights in a way that demands respect and admiration Rindo pays homage to my intelligent client.
“I also pay tribute to James Morton of the Scottish Trans Alliance, who helped me prepare the vital point on the scope of the Equality Act. I see no explanation as to why this resolution does not enlarge other complex gender identities such as agender and queer gender.
A spokesman for Stonewall, the UK’s LGBTQ charity, tells me:
“This resolution is a decisive moment in the detection of the rights of other non-binary and gender-based persons to be discriminated against under the Equality Act.
“Until now, it was unclear whether non-binary people would be through anti-discrimination legislation, which makes this labor court ruling so important. “
