O’Flynn Construction was ordered to pay legal prices similar to An Bord Pleanála’s application to the High Court to remove the company’s challenge to a new asset tax.
Judge Anthony Barr said he was not convinced that the challenge brought through Michael O’Flynn’s workplace was a paycheck case and awarded prices to An Bord Pleanála.
Last month, the High Court ruled that O’Flynn Construction Company’s challenge to a new tax targeting its undeveloped land on Naas Road in Dublin was moot and dismissed the proceedings.
An Bord Pleanála had argued that O’Flynn Construction’s arguments against it were “arguable” and that the original rateable land map had been abandoned.
