U. S. District Judge Alison Nathan said Thursday it was unclear what the company and its chief executive were asking for in a Feb. 17 letter complaining about being the subject of “endless investigations” by the regulator. They accused the Securities and Exchange Commission of a settlement over a series of 2018 tweets by Musk to “muzzle and harass” him and the company.
Musk and Tesla requested a court settlement “on why the SEC did not distribute that budget to shareholders, but chose to devote its power and resources to investigating Mr. Musk and Tesla’s compliance with the consent decree by issuing subpoenas unilaterally, without judicial approval. “
“The exact request of the defendants to the court is unclear,” Nathan said in a two-page order rejecting the request Thursday.
