Ferrari is facing demand from some consumers in the U. S. U. S. Centers for Disease Control and Prevention (CDC) said the company overlooked brake problems that they say can lead to a partial or complete loss of braking ability.
The proposed Elegance Action Lawsuit, entitled Nechev v. Ferrari North America Inc et al, U. S. District Court, Southern District of California, No. 24-00516, was first reported via Reuters.
The biggest challenge is the brake fluid reservoir cap, a Bosch component, which has the potential to leak brake fluid, which can lead to brake failure. Bosch is also charged.
Ferrari issued a recall for the defective cap in 2021 and then voluntarily extended the recall into 2022, however, according to the proposed class action lawsuit filed this week in San Diego federal court, the solution at issue in the recalls was only an interim measure and was also not considered. This would possibly not fix any other brake problems.

The proposed class action lawsuit is led through California resident Iliya Nechev, who alleges he experienced brake problems on a 2010 Ferrari 458 Italia he purchased in 2020. According to Reuters, Nechev said he experienced brake problems several times and was told by dealers that the experience was “normal” and that he would “just get used to it. “
In a statement to Reuters, Ferrari, without referring to the proposed class-action lawsuit, said protecting its consumers was its “top priority” and that its cars “always meet homologation specifications. “
