Court Dismisses O’Flynn’s Over New Naas Road Apartment Site Tax

The High Court has rejected a challenge through Michael O’Flynn’s corporate structure to a new tax on his undeveloped land on Naas Road in Dublin.

An Bord Pleanála effectively argued that the complex arguments through O’Flynn Construction Company opposing it were “moot,” insofar as the original map of taxable land was abandoned.

The Zoned Residential Property Tax (RZLT) was due to apply to eligible land from last February, but the Minister of Finance delayed its activation for a year and asked the local government to draw up a new list of sites for which it would apply.
