FOND DU LAC (WLUK) – A hit-and-run rate involving serious physical harm has been established in connection with an accident in which a motorist allegedly ran over two other people who had been ejected from their vehicle at some other twist of fate moments earlier. .
Jatziel Pabon Encarnacion, 19, made his first appearance Thursday in Fond du Lac County Court. An initial hearing has been set for Jan. 25.
A defense request to reduce monetary bail by $250,000 was denied.
The fees relate to the Dec. 31 accident in Auburn. Taya Grimes was killed and four other people were injured.
According to the criminal, a single-vehicle crash occurred on U. S. 45 near Sandy Road around 1:30 a. m. m. Al least four of the other people were ejected from the vehicle and two of them landed on the road.
While other cars dodged them, Pabon Encarnacion allegedly didn’t and hit them. One was shot in the head, while the other, Taya Grimes, was trapped underneath the vehicle and dragged for several kilometers.
The charge filed Thursday relates to the victim who was struck in the head.
When District Attorney Eric Toney was asked, after court, if dragging a body — in this case, Taya Grimes, was a crime — he said, “As prosecutors, we have to be able to prove our cases beyond a reasonable doubt and when you have injuries that may occur, you can’t prove when those injuries may have happened. Or, if the evidence suggests they may have occurred before something, that becomes difficult to try and tell a jury that they should find somebody guilty beyond a reasonable doubt, based on those circumstances. So, we have to follow the available evidence we have.”
Pabon Encarnacion admitted to drinking at a party before the crash, and the other people were injured in the first crash.
“The defendant admitted that he had traveled on highway forty-five and had passed through the place of the twist of fate. The defendant testified that he struck an object on the road at the site of the twist of fate and described it as a “speed bump. “He said he thought the object rolled onto the left side of his car. He said he had never strayed off the road. The defendant admitted that some of the damage to the new Mazda occurred that night, after he abandoned the report,” the complaint states.
No charges similar to underage drinking have been filed.
